Let me first thank you for your time. I really appreciate it. My question is:
I have a provisional "patent pending" status on my product. Can I start producing, marketing and selling this product now? Or should I wait?
Answer Your welcome...and Thank you for your question. I cannot give you legal advice on whether or not you can market and sell your product while it is patent pending, but my answer would be yes. If you look at a number of products on the shelves at a retail store.....there are a lot of patent pending products. As far as I know, you have to clearly indicate that the product is patent pending. I would make sure that your patent attorney has done the due diligence and patent search on other like products that are patented. I would definitely consult an IP attorney to get a definite answer. i wish you luck.
