Question
I am a salon owner, there is a product sold across the country to aid in a process in hair color. I have come up with an idea very similar, but different dimensions and pkg for a completely different application of a different service provided in salons...not for hair. Can I market and sell a product under those circumstances.

You can market and sell anything - it's a free country. Whether or not you might be infringing something is another issue.

As to the dimensions, that's difficult to answer unless there is some form of a patent specifically including those dimensions and functionality/design you intend to use. If those dimensions and packaging design are included as copyrighted artwork (you should probably check that out too) that might be a potential problem too. The fact what you have is in a different field may make a difference - not sure as I don't have enough info.

Packaging can be patented and Copyright protected; design of. So here again getting a patent search done or doing a free one via Google/patents on the product that is similar to yours to see if it was patented and if patent still current then reading its "Claims" is something you can do for free at a Patent and Trademark Depository Library (PDTL) in your area or online as mentioned above or via the uspto search site. You could also look for a patent number on the box or packaging or on their online website (if they have one) and copyright info can be found if registered via the Library of Congress; copyright section.  

There are many ways your question can also be answered but that's my answer at this time.
