Question QUESTION: When submitting a final Plat, is it proper for the sum of the lots to equal the total area of the land being divided?
Do you typically include the POB in a county road as part of the lots that front it?
ANSWER: In general, the sum of the lots should equal the total. some notable exceptions. Rounding may cause slight discrepancies. Also, comparing record total area to measured lot areas will usually result in differing totals. Typically I avoid the 2nd problem by stating both record and measured areas.
POB is very situation dependent. Is underlying road title fee or easement? Is parent deed to centerline? Most large subdivisions have road title vested in fee to DOT or HOA and it would be rare to begin POB at centerline. Smaller subdivisions where road title is easement may have POB at centerline. QUESTION: Is a road right-of-way the same as an easement?
Answer No, a road right of way is a type of easement or may not be an easement at all. Many right of ways are owned in fee title by an agency such as NCDOT. The type of taking is determined by the entity and owners at the time of taking or some legislative act or other authority may control.
