Question My step-father was served a civil summons and complaint (quiet title)in AZ. My question is can our lawyer file an extension of 30 days and would that be considered a sufficient answer to the summons?
Also, when I went to public records at Superior Court they have no record of the summons only the complaint. Could that imply anything?
Answer Mary,
The Superior Court records are sometimes inaccurate and the failure to show a summons does not indicate anything. Your lawyer can request whatever he/she likes by way of extension. If the other side does not agree, your attorney should comply with the time to Answer or should request an extension if one is necessary.
