Legal Ethics - HIPAA Concerning employer

Expert: Paul D. Friedman, M.A., Ph.D., J.D. - 3/28/2008

Question
Is it legal to give my medical info to the secratery of my employer over the phone or fax.The nurse said because the employer is paying my medical they have the right but this is the secratery she is just another employee

Answer
Alfred,

It is legal for you to give your medical information to anyone you wish.  Your employer is not necessarily entitled to information just because it is paying your bills.  If this is a workers' compensation matter, the state laws regarding physician patient relationships apply.  You can give limited consent to a provider per HIPAA and can revoke your consent at any time.

If this does not address your question, please give me more facts so I can respond clearly.

Very truly yours,

Paul D. Friedman, M.A., Ph.D., J.D.
