Legal Ethics - return money for chapter 7

Expert: Paul D. Friedman, M.A., Ph.D., J.D. - 3/13/2008

Question
hello,
we went to a free session on a bankruptcy and we ended up giving the lawyer 200.00 to file a chapter 7 I called twice to say we dont have the money to do the bankruptcy and could we get some or all of our money back.  and they said no I was wondering how can we get our money back or who can we contact about this matter? thanks

Answer
Rita,

If you feel the attorney took the money under false pretenses, you could contact the state bar and file a complaint against the attorney. If you feel they did not live up to their commitments, you could file a small claims action for breach of contract to recoup your money.

I wish you the best.
