Question I have just had my bank account garnished by a company in ST. Louis MO. I am on unemployment. My account is now overdrawn by 800.00. I contacted them asked them how they had the resources to find my bank account but not me for the last 2 1/2 years. I own a house and had a job until 12/7/07. Is it legal for them to not contact me and just attach to a bank account when it will over draw it and can they do this to someone that it will put an extreme financial hardship on? I live in Missouri.

It depends on your jurisdiction. Most jurisdictions mandate due process and notification to the debtor in a judgment debtor context.
Your financial situation would not be a matter for the Court if there is a judgment and they can probably garnish accounts within the parameters of the jurisdiction.
I suggest you speak to an attorney in Missouri to determine your rights. If you cannot afford to speak to an attorney, contact the lawschools in your area and ask.
