Subject: commisiion sales

Question
I am asking this question because I can not find any information on the question I have.  I am a commision sales person and I work over 70 hours a week But my question is if I have to work on a major holiday why am I not allowed to recieve special pay for that day I have to work every holiday and every other Sunday's which there is no added compansation I just can not seem to find at least the answer to those questions can you tell me where to look I live in the state of MASS.

Answer
John,

You need to call the Massachusetts Department of Labor.  Generally, commissioned salespeople are not entitled to overtime pay because they are paid solely on commission.  A commissioned salesperson can generally work as little or as much as they like unless you are being told where and when to work.

Very truly yours,

Paul D. Friedman, M.A., Ph.D., J.D.
