Question can a lawyer represent a client without client's signed consent, even though client's siblings have retained said attorney without the knowledge of the client?
Answer Patricia,
You need to be more specific. Some States require a signed agreement by each client in all circumstances. Some States require a signed fee agreement with contingency agreements.
Sometimes a statutory beneficiary can hire an attorney to handle the case and acts as a fiduciary for all of the other statutory beneficiaries. In this case, the others may be able to elect to hire their own counsel to serve their individual interests.
