Question how is a person found incompetent. can some who is not a next of kin have someone declared incompetent?
Answer Lydia,
Yes. Ultimately,the Court determines based on factual evidence (both lay and expert). The Court will listen at an evidentiary hearing to those that are around the person as well as psychiatrists as to whether the person can make informed decisions.
Usually, anyone can ask the Court to make a determination if they believe a person cannot make decisions or is a harm to themselves or others.
