Question
Location: Los Angeles County
Background: My uncle passed away 4/16/2008 and my mom (her brother) is trying to locate his will.  He left a will behind but he left it with his other sister (my aunt).  My mom and my aunt (her sister) are not on speaking terms.  My mom asked her if she could get a copy of the will and my aunt said her attorney will contact my mom.  We don't know who my aunt's attorney is either.  We do need to find the executrix because my uncle left us with bills and information that should be passed to the executor.

1. What is a reasonable amount of time we should expect the attorney to contact them? (e.g. 2 weeks, 4 weeks)
2. Is there a time frame in which the will needs to be filed with the probate court, or is this even required?
3. Do we have any recourse to obtain the will? (e.g. request for probate?)

Ben,

I am not a probate attorney and do not provide legal advice, however, the answer to your questions depend on your jurisdiction.  As a beneficiary, your mother will be contacted once the will is read or probate is set up.  The probate court is probably the jurisdiction to object to an estate if need be.  You may wish to check with a probate attorney in your area to determine if you can open the probate to force the disclosure of the will.
