Question Vanoni Biological Supplies, Inc., contracted with teh Hayden Institute to supply the Institution with 24,000 biological specimens for a series od experiments that the Institute has agreed to perform for the Maritime University of Columbia. The Institute must have the specimens by September 9 to meet the University's schedule. After delivering 12,000 of the specimens partsm Vanoni told the Institute that it wanted an additional 1600 dollar to deliver the remaining 12,000 specimens. Can Vanoni make the delivery of the remaining 12,000 specimens consideration in a new agreement with the Institute? Explain.

Vanoni is not providing any knew consideration by performing under the old contract with a new agreed price. Under the hypothetical you gave, the Hayden Institute is under no obligation to pay an additional $1600 because it has a contract which includes the 12,000 specimens yet to be delivered.
To have a valid subsequent agreement, Vanoni should offer something in addition to the 12,000 specimens to institute a valid contract with consideration.
