I've got a quick question regarding Obama's plans for judicial appointments. First, when are these made? I can't find anything recent in the news, just articles from during his election campaign discussing what he may do.
Also, who might he be interested in and why are people saying that Obama's choices will mark a clear departure those of the Bush administration?
Any info would be great as I know virtually nothing regarding this topic.
They nominated by the President and must be confirmed or rejected by the Senate (normally after hearings).
In order for Obama to nominate a judge there has be an opening.
At this point only has been nominated. Seventh Circuit Nominee David Hamilton. Given he was on the board of the ACLU and helped raise for ACORN (both far left organizations) a a track of being liberal activist judge. http://en.wikipedia.org/wiki/Judicial_activism
Liberal activist believe the Constitution meaning can change with the times. In essence, they can legislate from the bench with a liberal agenda.
Then there liberal judges who take an expansive view of Constitution
and conservative judges minimist view of the Constitution.
In theory there are conservative activist judges. (in theory)
In general conservative do not think you should legislate from the bench. I have never seen any real expamples of this.
Most of claims conservative judicial activism don't stand up well.
Some cite Bush v Gore.
The finding of equal protection violation in the recount was 7 to 2
with only the 2 liberal activist judges disagreeing. (Stevens &
Then there are Strict Constructionist.
They belive the Constistution means exactly what it says and if wish to change it you follow expressed amendment process.
Bushs judges were conservative or strict constructionist.
Obamas most likily will be liberal activist based his prior association and stated policy.
A liberal activist believe you have a right to privacy.
There is no expressed right to privacy in Constitution.
(thus why Roe v Wade is contriversal, there mo solid legal foundation to it. ) http://www.tourolaw.edu/Patch/Roe/#rop
Jane Roe (Norma McCorvey) is pro life activist.
She also admits she an alcoholic. She was never raped. http://en.wikipedia.org/wiki/McCorvey_v._Hill
A liberal activist believe you DO NOT have a right own firarms
even though this an expressed right.

QUESTION: Many thanks Paul! This is very helpful. If you don't mind I'd like to ask another related question. What specifically to Democrats and other liberals what to advance in the courts? I'm Canadian so I don't tend to hear as much of what's actively moving through the system. So, I guess to clarify, my question is what would Obama want to see done if he can assemble a liberal "dream team"? Does he even want left wingers in the same way that Bush sought after right wing strict constructionists?
Also, I've read a number of new stories saying that Obama wants to assemble a judiciary that can have Democrats and Republicans working together. Is this really the case or do you think Obama is going to try and directly challenge the Republican hold on the judicial system?
Sorry for all the questions,I just find this stuff quite interesting seeing as these individuals hold so much power. Also, the entire system is so much more fascinating than it is here in Canada, our courts are booooring.
Thanks again,
Matt
Answer
Hi again,
Its that that simple as what they are trying to push.
Its more about judical temporment and direction of the courts will be moving into the future. You really can not predict what will not be brought through the courts.
The courts are seperate co-equal branch of government.
Its niether Republican or Democrat.
There are plenty of lower level justices that were put on the court
by Jimmy Carter & Bill Clinton.
The court doesn't change quickly because they are lifetime appointments.
It that way with all federal judges. Its not just the Supreme Court as some Presidents do not ever get Supreme Court opening.
Once on the court they do not really directly interact with the President or Congress. The courts can't make them work together.
In terms of Obama, he never acted in a bipartician manor in his entire career. Its all just talk. Obama is not a moderate. He had the most liberal voting record in US Senate. The did not vote on alot of hot button issues, simply saying present.
35% of the the people who turned out to the Tea Party Protests are Democrats. They are shocked by what Obama and the Congress have done
so far in terms of far left and big government programs.
G.W. Bush is a moderate Republican. He was a little more conservative
GHW Bush was. He was not as conservative as Reagan.
