Expert: Haffiez Michael Lithman Date: 7/23/2007 Subject: FAQ of citizenship of foreigner and wedding between Malaysian and foreigner
Question Hi Haffiez, I would need your help on my situation, as detailed below.
I am a Malaysian Chinese and currently working in Malaysia. My fiancé is an Indonesian working in Singapore. He is a Singapore Permanent Resident since 5 years ago.
Now, we are getting married and plan to stay in Malaysia. My fiancé will still working in Singapore and I work in Malaysia. This means he has to travel in and out during weekdays.
My questions are:
1. He will be staying in Malaysia with Singapore PR status. Any issue?
2. Does he need any documentation such as Entry Permit or Certificate of Identity? If yes, how to apply?
3. Does having a Malaysia Certificate of Identity mean he is a Malaysia PR?
4. Any documentation requires renewal? If yes, what is the renewal frequency and renewal location?
5. How about my children citizenship? It will follow the country of birth or father’s citizenship?
Besides that, I am worried that our marriage is not recognized by Government of Indonesia, Malaysia and Singapore, as we will visit these 3 countries very often.
1. How to legalize our marriage, say internationally?
2. What are the procedures that we need to follow, especially the 3 above-mentioned countries?
Hope I can have your enlightenment for the future of my fiancé and myself. Wish you have a nice day!
Answer Thank you for you e-message received 23 July 2007.
1. He may enter and remain in Malaysia as a visitor. Make sure he doesn't overstay - which is unlikely as he enters and exits Malaysia every day. If he plans to apply for a Malaysian PR, he must be residing in Malaysia for more than 5 years or atleast have evidence/reason for applying the mentioned.
2. He is an Indonesian holding Singaporean PR, so he needs to present his passport when entering Malaysia.
3. He will be able to obtain Malaysian PR after residing in Malaysia for 5+/- years.
4. As he enters Malaysia as a visitor, he needs to renew his passport once it runs out of page.
5. They can be registered as Malaysian (if born in Malaysia) or Indonesian (born anywhere as the father is by birth and present an Indonesian) but they shall not have dual or multi citizenship (unless you do it secretly!)

1. As long as your marriage is registered with any civil court, it is recognised internationally providing evidence of marriage (Marriage Certificate)
2. Just get married and register the marriage through the right channel.
