Medical Malpractice - Birmingham Hip (BHR)

Expert: Glenn A. Dorfman - 10/15/2009

Question
Glenn,
What do you know concerning BHR. Mine did not go well. In November it will be a year. For some reason my Glutius Medius did not respond to PT. I have worked very hard for the past 11 months but it just won't come back. I have seen 4-5 Doctors and have had many tests and procedures. No one has an answer. I've heard more than once that if I had done a full hip replacement instead of the BHR I wouldn't have the problem. What do yo you know concerning BHR???
Steve

Answer
I really know nothing about the BHR other than from some brief research just now. The point with the BHR is obviously to take a much more conservative approach to the problem than what a total replacement would involve.  However, nothing can be guaranteed of course. I don't know if you would direct your complaints to the BHR company or your surgeon but in either event, and in all likelihood, the product is good and the surgery was done by the book. You unfortunately didn't get the result that was hoped for. Even though my knowledge is limited on BHR, I am sure there would not be a viable case of negligence against the doc or the company but even if there were, the damages are not severe enough for a lawyer to get interested. It would cost tons of money to pursue not to mention hundreds of hours.  At worst, you go back and have the total replacement done. I know that is difficult to think about but it would probably do the trick for you. Of course, it sounds like the problem isn't with the joint but muscle atrophy. Can't blame that on anyone but bad luck I suppose. Good luck.
