Medical Malpractice - Statute of Limitations?????

Expert: Edward A. Smith - 10/18/2009

Question
I am 31 years of age now, when i was 13 years old i was involved in a serious car accident, with the driver hitting me while crossing the street. With the assistance of my father i obtained a lawyer and i received a settlement in the amount $13,000.00. Because i was a minor my father was custodian of the account because i was unable to touch any of  the money until i turned 18. When my 18th birthday came i found out that my father spent all of my money, not one red cent was left. When i checked the bank statements i saw that he withdrew large amounts of money every other day. He made promises over and over again that he would put that money back and throughout the years he has not kept that promise. I haven't taken any action in all of these years because i believed that he would make good on his word and i didn't want to sue my father. But now he has said that he is not obligated to give me anything. Is there anything legal wise i can do to recover what he has spent?

Answer
Sorry to hear this Stephanie. The statute of limitations may have passed, however, this is a complex problem and I'd suggest you contact an experienced attorney in your state immediately.

Good Luck,
