Question i believe i had a surgery 3or4 years ago.....they kind of messed up but i want to kno how long is the time limit in MA for a medical malpractice case...
Answer The Statute of Limitations is 3 years from the date of the negligence or 3 years from when you discovered or should have discovered that malpractice may have occured but under no circumstances more than 7 years. This is a liberal statute. My state is one year. But "they kind of messed up" won't become a viable malpractice case. The "mess up" has to have been very clear and below the standard of care, not just an error in judgment or just because the result wasn't as hoped for. And, the damages must be very severe. If the damages to you are not into the 6 figures, no attorney would want to take it on. It costs tons of money to prosecute a mp case and even more time and energy of your attorney. Tell me what you think they did wrong and how it has harmed you to this day and I will offer an opinion on whether there is anything to work on.
