I have been a practicing civil trial attorney since 1989 dealing primarily with malpractice issues. I litigate very select medical malpractice cases on behalf of patients or their families. I am a Certified Civil Trial Specialist by the National Board of Trial Advocacy. I am also Certified in Injury and Wrongful Death by the Arizona State Bar Board of Legal Specialization.

In addition to my law degree, I received a Master of Arts in Bioethics and a Doctorate of Philosophy involving Medical Ethics. Because I am also an Adjunct Professor in Research and Medical Ethics at a medical school, I routinely consult with physicians and hospitals regarding medical ethics issues in an effort to improve patient care.

I can answer questions dealing with medical ethics principles. I can also respond to questions regarding potential malpractice issues.

Question
ON MARCH 24TH 2009 I HAD A VASECTOMY AT 780 MAIN ST WEYMOUTH FROM A DOCTOR FELDMAN. IMMEDIATELY FOLLOWING THE SURGERY I HAD IMMENSE PAIN IN BOTH TESTICLES AND SHOOTING PAINS THRU MY STOMACH. I WAS SCHEDULED FOR A PAIN BLOCK SURGERY AFTER MONTHS OF FOLLOW UP APPOINTMENTS AND A FEW TRIPS TO E.R. THE PAIN BLOCK WORKED FOR ONE DAY AND THEN WORE OFF WHICH THE DOCTOR FELDMAN SAID IT WAS VERY POSSIBLE HE CLIPPED MY NERVES  AND DID SOME NERVE DAMAGE. I WAS REFERRED TO THE PAIN CLINIC WHERE THEY PRESCRIBED ME NERVE MEDICATION AND PAIN MEDICATION AND REFERRED ME TO MY PRIMARY DOCTOR. I WENT TO A DR FRIEDMAN IN NATICK MASS BECAUSE I GUESS HE HAS DEALT WITH THIS TYPE OF PROBLEM BEFORE. DR FRIEDMAN PERFORMED SURGURY ON AUGUST 14TH 2009. WHILE I WAS LYING ON THE TABLE I HEARD THE DOCTOR SAY THAT THERE WERE CLIPS ON MY SOFT TISSUE AREA WHICH CONTAINS ALL MY NERVES AND THAT THERE WAS EXCESSIVE AMOUNTS OF SCAR TISSUE. THE SURGERY DID NOT WORK; I AM STILL IN AGONY BECAUSE OF THE NERVE DAMAGE. I HAVE SHOOTING PAINS UP MY STOMACH AND A CONSTANT PAIN IN MY TESTICLES. I AM SCHEDULED FOR ANOTHER POSSIBLE SURGERY BUT THIS COULD COST ME MY JOB AS I AM OUT OF TIME. I CAN NOT PLAY WITH MY CHILDREN THE WAY I HAVE BEEN USED TO ALL MY LIFE AND I HAVENT MADE LOVE TO MY WIFE SINCE THIS OPERATION. IT HAS TURNED MY LIFE UPSIDE DOWN. this dr feldman literally joked the whole time during surgery and was very unprofessional. i have 2 questions; can i be fixed? can i sue this guy for doing this to me?

Answer
John,

I am not a general surgeon and cannot tell you whether you can be fixed.  I strongly suggest you see another surgeon who can make the proper diagnosis and determine why you have these ongoing problems.

You are going to need to get a second surgeon's opinions as to whether the first surgeon fell below the standard of care.  The first surgeon may have cut a nerve, sewn through a nerve or moved a nerve which is causing you this type of pain.  Scar tissue also can form causing problems with the nerves.  

It is imperative you seek a second surgical opinion for a medical treatment opinion as well as a medico-legal opinion.
