Question hello my name is bernardo and i recently got spinal fusion l4,l5,s1 with 2cage 6screws 2 rods on july 6,2009 and i have been feeling alot of pain since i went to the surgeons offie 2week after the surgery with xrays and him and his p.a told me that everything was o.k and a week past and on the second and third week i got a mri and ct scan because of the pain i went to there office on the following week and they told me everything was o.k that its just the back fusion together maybe and that i would b ok then after that week i just kept calling them and told them i was still in alot of pain i then got and xray went 2 there office demanded to speak to the surgeon because the pain was getting worse my was back killing me and knees were starting to giveout they look the new xrays over then finally they tell me i have hardware failure and i was looking at the xrays ,mri, and ct scan over meself and to me it looks like the hardware failure was there all that time and they did not tell me until now oct,26,2009 i have 3 screws on the right side and 3 on the left but the left side is leveled higher then the right side where the rod goes through...is this malpractice
Answer You are lucky not to have suffered more injury from your back surgery. I have worked several of these cases, most with terrifying post surgical injury. But, you do have serious injury because of the failure of this kind of back surgery.
You need to find a good malpractice lawyer NOW. Stop horsing around with the doctor who injured you. Ask your local Bar Association for help finding a lawyer with experience in this kind of orthopedic surgery. I hope the lawyer you find has a neusrosurgeon with experience in correcting the damage done by your original back surgery. You will have to have anotherr surgery, this one to undo the damage done. A neurosurgeon will then have to attempt to fix your back. You did not describe your original injury that sent you to the doctor. If it was a workman's compensation case, ask your lawyer for that to help you find a good malpractice lawyer. The two lawyers will work together to find experts and develop your case. If it was not a workman's comp case but just an old injury that got worse, it may be harder for your lawyer. But, that should not be your worry. Get a lawyer with MONEY because these cases are expensive., Now, get started talking to lawyers. You need one.
