Question If a large medical company continues to market a hip replacement that they know is likely to fail early (10% at 3 years follow up)and have a high chance of leaving the patient with lifelong problems - what is the legal stand point for a patient who undergoes surgery when this knowledge was available and experiences early failure of their joint?
Answer I wish you could have been more specific in what you are referring to. What is name of the product and the manufacturer? Several years ago I was involved in litigation against Sulzer Orthopedics that was the major supplier of hip implants. Due to errors in the manufacturing process, approximately 5,000 people nationwide required replacement/revision surgery usually after months of suffering. The cases were eventually settled by reasonably large cash payments to each plaintiff. I keep my ear out for other cases like Sulzer and if there is currently an implant on the market that has a 10% failure rate at 3 years, seems to me us lawyers would have been all over that one. So what is the name of the product? Or, why don't you just google for it and see if there are any legal cases pending. Follow from there.
