Question Hello, in November of 2006 I had a scope done on me knee, I was told my knee cap was broken in the back which was causing issues. The surgeron told me he'd go in fix it and I'd be good as new. After the srugery I was back within 6 months still experiencing pain, the knee moved great but pain was still present, even worse than before. I was told at that point it is most likley arthritis and it happeneds to 20% of patients, I again was told I'd be good as new. Seeing how I was 28 I didn't buy it, I went to a different, more reputable surgeron, he informed me that I had metal in my cartilege which was more than likly causing the pain. He said the metal was most likley the cause of the tool that was used flaking and falling it but it was never removed. Its been a year and a half, 2 coridisonze shots and I still have pain, do you think I have a case?
Answer Possibly Tom. It depends on whether the metal flaking should have been foreseen and if the damages are large enough to warrant a suit.
I think you should consult with a local medical malpractice attorney immediately. There are short time limits for filing in every state.
