Question
I have a tubal ligation done August 2007. I have since been having severe abdominal pain and was hospitalized for it yesterday. I was told that I have a hernia that was cause by the tubal ligation, and now need a second surgery to correct it. Can I sue for at least the medical expenses? How about pain and suffering for the pain and suffering that I have been in for the last 2 years due to this injury?

Answer
The doctor who said you have a hernia resulting from the tubal ligation gave you your first notice of possible malpractice. The statute of limitations begins with that notice. So, you have, depending on your state's laws, at least one year before you can no longer sue.

So, see a lawyer now and get started getting compensation for your injury. Your lawyer will help you decide what your 'damages' are. Damages are the money value of your medical injury. Start looking for a lawyer now before you sign up for medical costs with another doctor.
