Yes they can but usually as a courtesy they will hold off until you get an answer from your insurance company. It would be nice for them to give you some extra time but they do not have to.
Perhaps call them and tell them you are appealing with your carrier and ask them if they would put your account on hold until you hear back from your appeal. Sometimes all you have to do is ask.
