Medicare, Medicaid, Insurance, HMO problems - Medicaid and Inheritance

Expert: John Pedit - 6/16/2009

Question
My sister is disabled and has been on Medicaid for many years. She is due to receive an inheritance from my mother in the future. Can she keep this money and property or will the govt. "look back" and take her funds for past services performed? Thank you
Mike

Answer
Hi Michael

Hard to answer because the Medicaid and the Recovery regulations vary from State to State.

However:  The money is usually considered income for the month received and  accountable assets from then on.  So she would lose Medicaid until
her assets were down to the right level.

If she received property that was considered accountable property she would once again lose Medicaid until the asset limits were met.

Check it out with her case worker.

John
