Mexican Law - FM2 for U.S. Spouse

Expert: LIC.D'LARA - 5/6/2009

Question
I am a US citizen, currently living in the US. My husband is a Mexican citizen, currently living in Mexico.

My husband is in Mexico because he voluntarily departed the US. We are going to have a US immigrant visa appointment in Ciudad Juarez, but husband will be given 10 ban to live outside the US. Thankfully, we will have the opportunity to file a waiver "perdon" for his illegal presence.

I want to apply now for a Mexican visa for myself because the US government may not forgive my husband and we might have to live in Mexico for 10 years.

I would like to be able to work, but I don't know any company or job that would sponsor me.

What is my next step??

I have downloaded the application for a Mexiccan visa. I have called the Mexican visa section at the Mexican Embassy in Washington, D.C. to ask some questions, but no one has returned my call.

Do I need to make an appointment, or just go? What supporting documents do I need to

Answer
As the spouse of a mexican national you will apply for a fm2 visa under the category of family sponsored. You would need to apply at the immigration office of the Instituto Nacional de Migracion at the place you will be residing in Mexico, presenting your marriage certificate and a sponsoring letter signed by your husband. Once you obtained the fm2 visa, you will be a legal permanent resident of Mexico and you can work in Mexico if you like. Please visit the internet page www.inami.gob.mx for more information about the requirements to be fulfill.
