If a US. citizen has a baby in a Mexican hospital wouldn't the hospital issue a birth cert.?


Hospitals in Mexico do not issue birth certificates.  The hospital will issue a "Certificado de Nacimiento" which is a form from the Secretaria de Salud acknowledging the birth and identifying the mother along with birth details and the babys footprint and mothers fingerprint but it is not a birth certificate.  

In Mexico only the civil registry can issue a legal birth certificate.  What you (mother) need to do is to take the Certificado de Nacimiento along with the baby and the yours and fathers birth certificates (with apostille and official translation if they are not registered in Mexico or they are in a language other than Spanish) and their official IDs to register the childs birth and then have a legal birth certificate issued.  

Then if you qualify and want to you can transmit your US citizenship to the baby by doing a Consular Report of Birth Abroad at your nearest US Consulate, details can be found here
