Experience
Former loan officer 23 of last 30 years. I have been a debt counselor and mediator since 1992. Current owner of Financial Emergency, Inc. A Debtor Advocacy organization. I also have a radio program called "Financial Emergency" where I routinely answer call in questions from listeners about credit, debt, and the collection system. My emphasis is on "Consumer/Debtor Protection" and the collection process.

Question
What is the difference if any between a collection agency that buys bad debt and an agency that is an assignee of the original creditor????

Answer
There is not much difference depending on the terms of an assignment. Some collection agencies have limited course of action in that they may not have the authority to sue someone on behalf of the original creditor where someone who buys bad debt is given full authority just as if they were the original creditor. However, some assignees do have authority to file suit. The thing is that if the original creditor wanted to just file suit they would without having to pay a collector to  do the same thing. They are there to collect money not necessarily file suit.
