Experience
Former loan officer 23 of last 30 years. I have been a debt counselor and mediator since 1992. Current owner of Financial Emergency, Inc. A Debtor Advocacy organization. I also have a radio program called "Financial Emergency" where I routinely answer call in questions from listeners about credit, debt, and the collection system. My emphasis is on "Consumer/Debtor Protection" and the collection process.

Question
Can charges be filed in Texas against me for not paying these loans because my account had to be closed?  This occured in 2005 they tell me.  The company name is USBI.  They want me to write an apology letter and give them my debit number.They say charges are going to filed on Monday for theft by check, internet fraud and one other thing. They said I could be arrested.

Answer
Do not give them banking information. This is a scam. I have received numerous calls and letters from being being threatened with jail, etc. The bank does not exist and they are macerating as a law enforcement agency. If they call back record their call and ask a lot of questions. Who the loan was with, how much, ask their name address, phone number and what agency they represent. Check them out on line with the attorney general in their state and yours. Then file a police report and a complaint with your state attorney general.

Above all don't let them intimidate you or scare you with their threats. They cannot do anything to you. If it were real they would file a civil complaint not a criminal one unless they can prove fraud which is hard to do. Just because you had money problems doesn't constitute a fraud.
