Question My dry cleaners in Boston, MA burned down last week, the day after I gave them $500 of my clothing to be cleaned. I want to find out from them if anything of mine was salvaged in the fire (perhaps my clothing was at an outside warehouse at the time of the fire?) but the building is all boarded up, their phone is off the hook, and I cannot get any more information about their business from City Hall, the Secretary of State, or the Attorney General Office. What are my legal rights in this situation, and what is the next best step?
I would like to firstly find out if my clothing is burned or not, and secondly file a claim with the company's insurance for compensation if my clothing has been ruined.
Thank you very much for any advice you have.
Answer Your secretary of state should have a listing for the company's statutory agent. This is the person of record who would be responsible for recieivng notices of pending legal action or other important communication. If none is listed I would be concerned whether they were a legal business entity.
Locate any names and addresses associated with the business and send certified letters, return reciept and forwarding orders requested. The post office will return the signed receipt and forwarding address to you for future communication. They have a legal responsibility to you so pursue this aggressively. There should also be a tax address with the auditor's office where the tax bills go. Use this as well.
If this doesnt work palce an ad in the paper giving them public notice. Maybe others will see this and contact you with valuable information. I am sure you are not the only one in this position with the company. If they neglect to take care of business file suit in small claims court.
