Question QUESTION: Hello, I had a judgment and lien filed against me in 2004. I had paid the amount down from 6k to 2k, but was late adn the creditor would not accept my payments so I stopped. Now there is a new law firm contacting me asking for 4,800. I have since married and my married name is on a property in another state. Can the new law firm attach a lien to my husband's house even if I am not on the mortgage. Does it matter if the name is incorrect or if I have not officially changed my name? I'm concerned that they will impact his credit.

The firm is SmithDebnam in Raleigh. I started to do a quit claim to take my name off my husband's property, but the name is not the same so I am stuck.
All my official bills, id, documentation etc are in one name. This deed has a different last name.
ALso, the letter they sent threatened lagel action. Can they take me to court again?? Even though they have a judgement and lien against my own property?

They can attempt to go to court again to force action upon collecting the judgment.
This company is attempting to scare you into paying them. I'm 100% positive if you had the money this situation wouldn't exist.
The name on the account doesn't matter, as long as they can prove it's the debtor that owes the debt, they can attach property.
In your state chances are that you're exempted from certain tangible property from being seized.
