Question
This question was prepared from my friend.I got confused with this question.

A consignment of Australian wheat sold on CIF Beijing terms to a Chinese buyer has been seized by pirates during the ocean voyage and is now considered lost.

I would like to know should buyer accept the shipping documents representing the wheat and make payment for the wheat?

Answer
If CIF Bejing was concluded between the Australian seller and the Chinese buyer this would mean that the Austarlian seller and supplier has the risk that the freight gets lost.

The Incoterms however do not stipulate the legal consequences (no redelivery and no payment/ redlivery and payment).
