Question I am considering suing someone in Turkey for a debt they owe but am not too confident in the Turkish system, I am considering suing in Germany and legalising that judgement in Turkey. Can you please confirm the following:
1. Is the process simple, for example would I just need a German lawyer or does a Turkish or 'international lawyer' need to be involved?
2. Where I can obtain more information about this process?
3. Where I can locate a law firm (or recommend one) that specialises in this process? Is there an official list of lawyers that are authorised to complete this process for example?
4. What the normal costs involved in legalising in/transferring to another country are?
Thank you,
Answer You can only sue in Germany successfully if German courts are internationally competent for the case. You should have that checked first because otherwise you would have to take legal action in Turkey.
After being awarded a judgement it is subject to legalization by the Turkish authorities. How and at which authority such approval can be obtained is a matter of Turkish law and therefor asking a Turkish lawyer in advance sounds reasonable to me.
I do not know about official list. I would recommend you to place an inquiry directly at a Turkish law firm or to get in touch with the embassy of your country in Turkey.
