Question
I am an Italian citizen living in Genova. I am writing to ask you for information at the request of a friend of mine. She is a Cuban girl who is married to an Italian citizen. She has a permesso di soggiorno, it will be being renewed in October. She would like to know what the laws are with regards to her divorcing her husband before having her Italian citizenship (she has not yet applied for it, but will be in March of 2006). If she divorces him before getting her citizenship will she lose her permesso di soggiorno? Will it be changed to a permesso di soggiorno for work (i.e. will she have to work in order to stay in Italy). Will she be expelled from Italy? If she has somewhere and someone to guarantee that she will be taken care of can she somehow remain in Italy and still apply for her citizenship? What are the laws governing such a case? Please any help will be appreciated.

Thank you,

Answer
Generally speaking a person to obtain the italian citizenship must be married to an Italian citizen at moment which the request is filed.

It is very difficult to examine this position without having deep informations, therefore I suggest you to request a legal advice to a lawyer in Genoa, to avoid any risk to loose the permesso di soggiorno.

Best regards
