二手房屋交易如何办理过户登记?
一、办理过户登记手续的条件:
持有房地产证的房屋出售,交易当事人应当签订书面合同,并申报成交价格,到市房地产
交易中心申请办理交易过户和登记手续,购房者领取房地产证。
2、若属抵押(按揭)购房,在办理交易过户同时办理抵押登记,核发《房地产他项权利证》给银行。
二、二手房办理交易需要缴交的资料
(1)广州市房地产证买卖登记申请表
(2)广州市房地产买卖合同
(3)房屋买卖征询意见通知(房屋属共同共有或出租或房改房的)
(4)房地产证(如两人以上共有,提交共有证)
(5)测绘分户图(按申请户数)
(6)买卖双方身份证明
(7)解困房买卖合同(属解困房)
(8)地价评估答复书(未办土地有偿出让手续的房地产)
出售或购房一方属单位者,还须提供以下资料:
(1)营业执照复印件
(2)法定代表人授权委托书
(3)法定代表人和代理人身份证明
(4)有关部门同意出售或购买的证明
属抵押(按揭)购房者,还须提供以下资料:
(1)广州市房地产他项权利登记申请表
(2)抵押物价值评估书或双方确定价值协议书
(3)抵押合同和主合同
(4)主管部门或董事会同意抵押的证明
(5)金融机构法人资格证明
(6)金融机构法定代表人授权委托书
(7)金融机构法定代表人和代理人身份证明
三、流程图:
收件前,申请人到测绘部门办理房屋面积测绘或转绘,领取结果
申请人备齐资料到收件窗口申请登记
收件人员进行收件预审后立案受理,预约过户时间,涉及抵押(按揭),同时受理抵押登记,核发《房地产申请登记回执》。
办案人员对资料进行审核,根据需要进行现场查勘和评估
申请人按预约的过户时间,到过户窗口领取缴款单,缴纳有关税费
申请人凭税费发票到过户窗口办理交易过户手续
申请人到发件窗口领取房地产证。属抵押(按揭)同时领取他项权证。
四、办理期限:从收件窗口立案受理,领取《房地产申请登记回执》之日计算10个工作日。(涉及其他登记业务合并受理的,相应增加该业务办理时间)
五、收费标准:

房地产平面附图转绘   按房屋面积测绘收费标准的30%   
另外,需到财政局缴契税,到税局缴印花税、土地增值税、个人所得税

卖方:房屋产价的0.05%   每宗房屋交易
契税   买方:个人购买普通住宅按产价1.5%计收,其余按3%计收   每宗房屋交易

个人所得税   卖方:具体标准由调房总站核定   房改房上市,未住满5年
六、领证须知:
权利人(或合法代理人)持本人身份证件(原件)和已缴税费收据(原件)及《房地产申请登记回执》(原件)到发件窗口领证。
领证时请仔细核对领取的权属证明文件。
