Subject: Incorporating required?

Question
Hey Harvey, I was wondering if a non-profit (non-church) can be established  without having to incorporate?

Also, in regards to self dealing..If a board member also provides services (Hypnotherapy)  is he allowed to be compensated separately for those services or should that be part of his normal salary as a board member?

Answer
Yes, it can be an unincorporated association with articles of association in most states. This forum is only for federal tax questions regarding 501(c)(3) public charities as I have explained in my profile, so you would need to check in your state's law. A Board member may be compensated separately for his services. That members should not vote when the Board decides upon the compensation package.
