Subject: Requirement by Dance Studio

Question
Can the Dance Studio require a team member or parents of a team member to participate in X number of fundraisers in order to stay on the Dance Competition Team. I realize the Booster club can not reqire members to participate.

Answer
It appears that you are asking about a Dance Studio that is a for-profit organization.  If the booster club is running the fundraiser, it may not reveal to the Dance Studio who is participating, as that would be only for the purpose of conspiring with the Dance Studio to evade taxes. You do realize that a booster club many not require members of the team or their family from participating and, therefore, the booster club may not conspire to get the same result by revealing information to the Dance Studio and allowing such influence by the Dance Studio.

See www.irs.gov/pub/irs-tege/eotopica93.pdf especially pages 11-13 about too much Gym Influence indicating private benefit in an amount not allowed for a booster organization that is a 501(c)(3) organization.
