Nonprofit Law - School district not claiming booster club

Mr. Mechanic,

I wrote you recently about the school district, when asked for financial information regarding our dance booster club, said it wasn't obligated since the booster club was a separate and legal entity.  Since then, our company lawyer told us to look at the back of the checks they cashed from the booster club (there were alot of them) and see who cashed the checks and where they were deposited.  It said on the back of the check that the monies went into the district school fund, not a booster club.  So does that fact hold the school district responsible for turning over the financial information if it is deposited into their school account?  Thanks for any further help you can give us.  You've given us alot so far.  Sincerely, Sherri Walker

Answer
Certainly now the facts are different from what you described earlier, as the funds going into the school account would require the public school to give financial information.

As for your state law on Open Records and Open Meetings
See www.rcfp.org/ogg/index.php?op=browse&state=mn
but change the last two letters from mn to your state's two
letter postal code (unless yours is in Minnesota)

I.C. has the list of Records that must be made available by applicable organizations.
