Experience I have been practicing law and especially the law of nonprofit organizations since 1990 when I was admitted to the New York Bar.
Education/Credentials B.S. Columbia University in New York City, 1970
J.D. (Law Degree) Brooklyn Law School, 1990 -- Cum Laude
Question I realize this may seem like a simple question; however, we receive Federal Funds and from what I understand we are drawing down the allocated funds through our budget. We are not even receiving the amount of salary that is budgeted per employee. "As a smack in the face we are paid minimum wage if our timesheets are turned in late. The company pays $5.15 which is not even min. wage but we are told they can pay that because they are non-profit. What is the minimum wage they must pay?"
and was asked on 06/29/2009
Answer I don't know what you mean by "and was asked on 06/29/2009". I have reviewed the questions on that date and none were from a Donna.
Anyway, there is no general exemption to the minimum wage law for nonprofit corporations. See the Federal Fair Labor Standards Act http://snipurl.com/4gpov [www_law_cornell_edu]
which is the federal law that would apply to such employees. http://tinyurl.com/dx4bwv
is a good general article. The Federal Fair Labor Standards Act
(FLSA), applies to all states. Therefore, just ignore the Texas
information if you are not in Texas.
Some states provide more protection for workers and, therefore, I
suggest that you contact your State's Labor Department, Wage and
Hour Division. If you give me your state I may be able to direct you.
