Question In 2006 I purchased an undivided interest in two islands on the Louisiana coast. The same year Newfield exploration installed a pipeline under my property without getting a right of way contract from me or my ancestor in title. Now they want an after the fact contract. Since the pipeline was installed under property that I own an undivided interest, without my permission, can I claim ownership of a portion of the pipeline relative to my share of undivided ownership in the land? And can I demand a portion of the profits from the operation of the pipeline?
Answer Sir, I am uncertain what rights you have to the production running through the pipeline. Anytime operations are conducted without the permission or agreement of the landowner, the Operator is, in my opinion, in violation of the landowner's rights.
I would suggest you contact an oil and gas attorney who has experience in offshore oil and gas negotiations to assist you in this matter before you sign and enter into any agreements with the company contacting you.
