Oil/Gas/Well assignments, division orders, and procedure guidelines


Hi Mr. Scott,
i have what I hope is an easy question involving division orders.  If Company A assigns a working interest in a well to Company B effective 1/1/2013 but does not receive all of the documentation until 5/1/2013, what date should be entered in the division order?  And do you know if the NADOA publishes a set of standards guiding issues like this?

If the assignment itself states effective 1/1/2013, then that's when it's effective. The "standard" is that the grantor should not have agreed to an effective date of 1/1/2013 unless he/she were okay with it. There really is no legal standard for this type of thing as far as I know so you go by what the actual assignment says if it specifies an effective date.
