My cousin and I have signed Oil & gas mineral leases in Leon
County, Texas. My question is the land man that works for the
production company is getting all heir together and I have an
uncle who was married and his children has obtain an affidavit
of heirship, that same uncle had outside children from different
women say three children total that was not in a marriage union.
Can the land man prove heirship from my uncle's obituary that list
those other children and the son and daughter that has filed the
affidavit in the county where the property is located and the county
they live in which is Harris County. The production company says
the would add those children in to our leases because of blood
interest so, my question does the affidavit of heriship stand against the obituary and the outside children that is in question.

An Affidavit of Heirship is filed of public record so that third parties can be put on notice and if the facts contained in the Affidavit are untrue, then parties who can establish different facts have the opportunity to do so.  However, there is only a certain amount of time that the facts can be disputed.  

You should contact an attorney who can help you have the correct facts represented in an Affidavit of Heirship for your uncle, and have it recorded in the records in Leon County, TX, also.  Then, make sure a copy of the recorded Affidavit is furnished to the production company which should cause the production company to suspense the royalty revenue until they have made further efforts to establish the true heirs of your uncle.

Lyedea, this should be enough to prevent the production company from paying the incorrect heirs.
