My area of expertise in organized crime is drawn from actual experience. Maxwell Caulfield is not the name I was given at birth. It is the name that was given to me by the United States Government, through the Federal Witness Protection Program. I am one of only 2% of more than 16,000 witnesses who does not have a criminal history. My experience stems first, from my emloyment by organized crime figures in Chicago, IL. And then my testimony for the U.S. Attorney`s Organized Crime Strike Force for the Northern District of Illinois. I testified against organized crime figures and corrupt police officers. All were convicted, and sent to federal prison. Since this event 20 years ago, I have spent a great deal of time working in the field of investigations of organized criminal activity, violations of the R.I.C.O. statute and have been an outspoken critic of WITSEC. Question My fiance and I are trying to figure out who he would contact regarding questions about him being in the WITSEC when he was younger.
My fiance's father was involved with organized crime in New York in the 80's. In the early 90's his father was put in the WITSEC so my fiance chose to go with his father and entered the program as well. His mother was already divorced from him and she stayed in New York.
My fiance left the program by just moving back home and reassuming his last name. He did not formally leave the program I guess you would say.
Now more then 10 years later he has questions. Under his real name he has no criminal record, BUT while he was in the program he was a dumb teenager and has a few offenses.
He knows that if he ever gets fingerprinted some type of red flag would go up and the FBI would have to be notified. Some questions we have are: (1) does he have to list his names while in the protection program on an application for a US Passport? (2) he is looking into a career that requires state licenses and background checks......does any of his "life while in protection" have to be disclosed? (3) what happens if fingerprinted for a state license under his real name -- will his record while in protection affect him?
We have more questions of this sort, but are not sure who to contact. His father is difficult to deal with and he says oh it will all be ok, but we just want to make sure.

Good question! So good it freaks me out a little bit. And here's the "rub" so to speak. I would like to help because I certainly know the answer to all of your questions...and I wish I didn't because I know from personal experience. The problem is this public forum we are talking on will be viewed by people all over the world until the "end of time" or at least the end of the Internet and that's probably the same thing. In order to completely answer the specifics of your questions or even to give general answers, I would have to expose details about cover building procedures & background protocol's regarding Witsec provided services that I'm not willing to provide, at least not on this forum. It would be irresponsible and worse may prove dangerous or at least counter-productive to many protected individuals and the people tasked with providing that protection. It could also prove helpful to a shall we say "segment" of our society that consider themselves to be very "wise" guy's. And personally I wouldn't have any interest in helping any of those guy's unless they were looking for help in getting into a federal prison...other than that, I would not be much help at all. Also some of what you are asking will entail answers that could be construed as legal advice, which is another thing I cannot do...I'm not an attorney. Which brings me to my answer...sort of. Your husband needs to speak to an attorney and/or to a representative of the U.S. Attorney General's office at the Department of Justice about these matters. The fastest route would probably be to seek out a criminal defense attorney who is board certified in criminal trial law and most importantly a former federal prosecutor. Now that may sound complicated but there's more of them than you might imagine, I have four that fit that profile on speed dial. That attorney will either have the answers to your questions, know where to find the answers, have contacts that can help, or be able to help you approach the DOJ with your dilemma for some assistance. He or she will also be bound by the canon of legal ethics and the law to keep your personal business confidential. If you cannot afford an attorney then I suggest you write a letter (not an e-mail) to the United States Attorney General in Washington, D.C. and the AG will put that letter on the desk of someone who will answer it and may be able to help. I'm sorry I can't just answer you, I would like to but I would like to see the Chicago Blackhawks win the Stanley Cup in my lifetime as well and on the Internet I can't even be sure of who you are, let alone know who else will read my answers down the road.
