I wrote about a week ago about a fall I had a Target.  Thank you for such wonderful advice.  I have found an attorney who is now investigating.  I was told that Wal-Mart has cameras in their bathrooms and that Target probably does.  When I called Target I was told by a Manager and the Security department that they don't have cameras in the bathrooms so I am not able to get a tape of my fall for legal reasons.  Have you heard if Target does in fact have hidden cameras in their bathroom, and they are just willing to give up the tape?  My attorney said Wal-Mart does,but I looked very hard and did not see any.  How can I find out for sure?

I am happy to hear that your claim is proceeding so well, and I do hope that you will consider some of the comments I had for you on the brain injury and the TMJ.  And again, thanks for your kind feedback—I appreciate that.

As for the cameras, that is a simple matter that your attorney can ask in a set of interrogatories during the discovery process.  They will not only have to reveal whether or not they have cameras, they will also have to give your attorney any tapes of the time you were in there (supposing there is a way to block out the view of others).

Now, if your attorney wants to try to settle without bringing a lawsuit, she can try something that may or may not work.  In the past personal injury trials Doctor Settlement insurance adjuster adversary got a set of interrogatories even though we had not yet filed the lawsuit.  These were limited to that one topic I wanted to know about.  

I sent a letter explaining that we wanted to settle, but that it would be impossible without knowing the answer to this one topic.  Most often, the adjuster would NOT answer them, but she would yield to me the information I sought via a phone call or even a brief letter.  

For example, in this case, I would send the adjuster the set of questions—NOT a full blown set of interrogatories, but just questions dealing with that one topic I wanted to know about.  If the adjuster wants to work with me, then she will let me know the answer since she knows that I will be forced to file a lawsuit otherwise.  You might see if your attorney would be willing to just send along an advance set of questions with a nice letter as I discussed.  Perhaps the adjuster is interested in making a settlement and so you will have a response.  But in a case of contested liability, it is more difficult to entice the adjuster to play along toward a settlement since her marching orders might be to pay only nuisance value on a claim.  We just do not know that as of now.  Hopefully your attorney can develop facts that will support liability on their part.
