Question
I fell in the building in job when I was 23 weeks pregnant (on 10-8-08).  I was coming into work and someone had urinated in the elevator.  I walked aroundit but when stepped out of the elevator I fell maybe due to someone else having stepped on it and dragging it out.  After that delivered my baby on 11-1-08 @ 26wks 6days. My baby weighted 1 lb 5 ozs. I was having preeclmpsia that developed after my fall.  I hurt my knee and am seeking medical care now.  The building know they are negligent because they were aware of the urine on the ground and did not clean it.  The urine came from a person going to the program for mentally challenged adults.  The building porters failed to mop it up.  
The insurance company continues to call me to see how I am and how my baby is.  They want me to sign papers.  What do I do?

Hi Stephanie,

I hope that your baby does not have any long term impacts from your fall.  This is a serious claim and you need professional legal and help.

This is NOT something that you can or should do on your own.  Dr. Settlement knows personal injury self help insurance claims, so I AM in a good position to tell you that THIS IS NOT one of those claims that an individual can do on her own.

Here is why. You have a combined workers' comp and third party claim that involves both an injury to yourself AND a possible connection to your baby.

You cannot go on the fact that you developed a condition after the fall.  Nor that your baby arrived early.  Your attorney is needed to tie the fall to both of these problems.  Preeclampsia is a disorder that affects at least 5-8% of all pregnancies, and there ARE A LOT of reasons for it.  So one cannot just tie your fall to this condition, or to the baby's early arrival without STRONG MEDICAL PROOF. And that is what ONLY the attorney can do and you cannot do.

Please do not become confused by any offer from the insurance company.  They are going to try to fool you and offer very little for a claim that could be very large IF YOU GET YOUR ATTORNEY.

The attorney will take your case without you having to pay her anything.  That is the beauty of the contingency fee system: ordinary people get access to the legal system without having to pay any money up front. You put all the risk on the attorney.  Does that make sense?
