Question
Our granddaughter fell on the tile at the bottom of the tube slide, in the McDonalds play area.  Some play areas have carpeting or some other type of cover on the tile, but this particular one only has the tile.  I immediately left after another parent gave me a bandaide to hold the cut together, on her chin.  A McDonalds employee did quickly show up to wipe up the blood from the floor but never ask about my granddaughter.  I took granddaughter to the hospital ER, and called her dad who was working out of town.  I reported to the ER the place and time of incident and after spending the next four hours there, granddaughter ended up with 15 stitches in her chin.  My question is, this incident happened three weeks ago.  We were under the impression that our son had talked to McDonalds about this to see if their insurance would at least help with the medical bills.  Our granddaughter as no health insurance.  Is it too late to legally go to McDonalds to ask to fill out an incident report?

Answer
It was no doubt a mistake, but excusable under the circumstances, that you did not insist that the manager be informed and that details of the accident be recorded.  No harm in calling the restaurant now to see if any report was made.  In any event, tell them you want to know who to contact regarding the medical bills. If the hospital records record that the injury was suffered at the McDonald's play area, that might be good enough for the insurance company for the restaurant to agree to pay any out of pocket medical expenses.
