Question My child fell out of a crib at daycare when the bottom of the crib gave way. She was asleep when it happened. she was not hurt physically but it could have traumatized her. How long can you wait to file suite if you want. Is it even grounds for suite if the child appears to be physically okay?
Answer Hi Tameshia,
I am sure you are thankful that your child was not hurt. It is tough to see our little ones suffer any kind of trauma. But that is part of life; we all have some bumps in the road, and there is no economic remedy for the vast majority of problems that get thrown at us in this life.
And in this instance, the main thing to take care of is the crib. Make sure the crib is fixed. You say nothing about the caregivers so I assume you are happy with them. The fact that the crib failed is probably not their fault. Just make sure they get it fixed.
As for a lawsuit, there is none. There are no damages. Even if you could prove negligence on the part of the caregivers or the crib manufacturer, then what would you do about damages?
If the baby is fine; she is not going to get an award by you speculating that the baby was traumatized. No one can prove that.
Bottom line, give thanks she is OK, check on the crib, and move on with the next thing in the lives of Mother and daughter.
