Question IS THERE ANYWAY I COULD FIND OUT IF MY LAWYER RECEIVED OUR SETTLEMENT CHECK. HE'S BEEN STRINGING ME ALONG SINCE JUNE 2008. HE RECENTLY TOLD ME 5/28/09 AND RECANTED WITH A POSSIBLE 2 MORE MONTHS. I WAS TOLD THAT THEY PUT YOUR MONEY IN A CD TO MAKE EVEN MORE MONEY OFF THE SETTLEMENT. PLEASE ADVISE
Your State Bar Association will have someone who will help you to make a complaint versus your attorney. The first part of the complaint is (1) failure to communicate; the second part is (2) inordinate unexplained delay of case; the third part of the complaint is (3) suspicion of theft of client funds based upon deceptive statement that the award will be put in a CD format.
This last part is a flat out deception so far as I led to believe from the context you gave to me. It is true that one can agree BEFORE signing a settlement to put proceeds into a "structured settlement" agreement by which the interest earned thereon is tax free. BUT YOU WOULD HAVE BEEN INVOLVED IN THAT CHOICE.
As I understand what your attorney it conveying to you, this investiment was done WITHOUT your knowledge. That is the dece[ptive part of this and it should be the basis of AN IMMEDIATE COMPLAINT TO THE STATE BAR ASSOCIATION.
You will be able to get your settlement money if it was obtained by deception or fraud by going thru (1) your attorney's malpractice carrier, or (2) your client relief fund (if any) with the State Bar Association, or (3) if a fraud has been committed, then thru your state crime victims fund (if any).
