Question Wal-mart gave me a medication that was not mine. I didn't realize that it was not mine until after I took it and started to feel dizzy and nausea.I went to look at the bottle to figure out why I felt this way and realized it was not my name or my medication on the bottle.Called the Pharmacy and he was more worried about getting the medication back than he was about my well being.I ended up going to the ER, they said it was a drug reaction and I should be fine, but gave me some nausea medicine after being there for 4 hours . After the dizziness and nausea passed I'm still sick with diarrhea. I talked to Wal-Marts claim department and they offered me $1000. I need to know is it worth it or should I get a lawyer?
Answer Well, Courtney, that is kind of a scary story. Glad no harm was done.
Dr. Settlement is best at personal injury claims, and what you present is foreign to me. Hence I have no idea about anything that is not the result of an accident or dog bite.
Maybe call a couple of attorneys to get their thinking. My two-bits worth would be to make a detailed record of how you felt and how scared you were, etc. DO NOT PHONE THEM, but instead send it by email. With something like that in writing, you can counter for more money.
Maybe ask for $1,500 in addition and see what happens? Maybe the attorneys you will ask have a better read on valuations for this kind of claim.
Best wishes,
Dr. Settlement, J.D. (Juris Doctor)
