HI,I had a auto accident while staying in Florida,I spend time in fl. and live and have my car registration in NY.I have a NY auto Policy. My question is do I hire a NY attorney or a FL. Attorney

Hi Marie,

This is a great question since a lot of us travel so much these days.  Any claim that does not settle has to be tried in the state of the accident (or you could sue the tortfeasor in her own state).  Hence, Florida is the place with jurisdiction and venue for this case.  So if it is likely to go to trial a Florida attorney will be needed at some point.

BUT I live in Washington, and my clients had accidents in California and Oregon that I handled by demand letter an phone from my office in Seattle.  Likewise, a NY attorney could handle such a claim from your home area.  It is not hard to learn the law regarding traffic accidents inasmuch as the Internet yields all statutes and case law.

Hiring a local NY attorney gives you the convenience of having your attorney close by.  No problem getting in to her office.  AND if a trial is necessary in Florida, then she will find an attorney for you and the two of them will decide between them how to divide the one attorney fee.  You will not have to pay two attorney's fees—there will be just the one fee and the attorneys divide it.  

Does it make sense to you to let you local attorneys take a shot at getting you a settlement, and then turning it over to the Florida trial attorney only as necessary for the claim to go forward?  The e-mail is just as quick from your computer to the attorney, irrespective of whether or not she is in NY or Florida.  Right?

This stuff is not rocket science, but it will take some effort on your part to read and cut and paste letter examples and to communicate.  But hundreds of people are doing it each day, and they are getting good results.

FINAL TOPIC, Marie: Effective communication with insurance claims adjusters.  Establish Firm, Professional, and Positive Relationships With the Insurance Injury Claims Adjuster http://www.settlementcentral.com/page0059.htm

Always communicate with the adjuster in writing, showing your own analysis of value. It is OK I guess to have one call or so, but no more.   Always have your information and ammunition in writing to give to the adjuster.

Let him know that you are FIRM IN YOUR RESOLVE to get what you are demanding (NOT "asking", since that invites a counter-offer, but instead "demanding" as fair and reasonable compensation) by asking him what the options are to resolve the matter fairly should he not agree to a reasonable claim value. In other words, let him know that you will go through with a court filing if need be.

Remember these tips, do your homework, print out your evidence, show resolve to get your fair settlement, and you will DO JUST FINE.
