Question My husband and I had a car accident almost a month ago, he has neck, shoulders, back and knee injuries and i back, neck and a wrist sprain I've been out of work for more than 3 weeks and will continue to do so for 2 month more ask my doctor said... i ask my lawyer if i can received disability from the city i had been working in that company for 2 month .. but my husband is not working neither do i we have a 6 month old a rent to pay and all other expenses... what should i do?
Answer Ask your lawyer to make a first party claim for you against your own coverage if you do have something that will pay lost wages. Most states do have Personal Injury Protection (PIP) or like coverage that pays about 85% of your wage loss, BUT ONLY AFTER YOU ARE OFF TWO CONSECUTIVE WEEKS. So DO NOT go back to work just one day to try it out. You have to continue to stay away from work until you qualify.
I am afraid that it is too soon to ask the lawyer to make a demand letter. Injuries like these sometimes have a way of coming back once the body is exposed to physical demands. Hence, your attorney will want to get things going on her demand letter, but only AFTER she is sure you both are pretty much healed.
One additional source of immediate cash is to borrow against the award you expect to get from the insurance company. There are dozens of companies that will loan you money on your claim, especially if you have an attorney.
But be sure to have your attorney go over any such contract to try to negotiate any possible reduction in the interest rate. The interest rates on these loans ARE VERY HIGH. So get your attorney to write a brief letter to the company lending the money and fight for a lower rate.
